§2. Definitions

For the purposes of these Terms and Conditions:

  1. Store – the Alternative Photographic Supplies online store operating at www.alternativephotographicsupplies.com.

Entrepreneur with consumer rights – a natural person entering into a contract directly related to their business activity where the content of that contract indicates that it is not of a professional nature for that person, arising in particular from the scope of their business activity disclosed in CEIDG.
  6. If it is not clear from the contract to be concluded whether it is of a professional nature for a natural person conducting business activity, that person may, no later than at the time the contract is concluded, declare that the contract is or is not of a professional nature for them. The Seller shall not make conclusion of the contract conditional upon submission of such a declaration.
  7. Goods – movable items offered in the Store.
  8. Digital Content – data produced and supplied in digital form, including in particular an electronic book or another downloadable file.
  9. Workshop – a training or educational service taking place on the date specified in the offer description.

  12. Business Day – a day from Monday to Friday, excluding statutory public holidays in Poland.

§3. Services Provided Electronically and Use of the Store

  1. Through the Store, the Seller provides electronic services free of charge, including in particular:
    • browsing the Store’s offer,
    • using the Order form and shopping cart,
    • creating and maintaining a customer account,
    • publishing product reviews, if this function is available.
  2. To use the Store, the following are required:
    • a device with Internet access,
    • an up-to-date web browser,
    • an active e-mail address when placing an Order or creating an account.
  3. The Buyer may make a purchase without creating an account.
  4. Creating and maintaining an account is voluntary and free of charge.
  5. The agreement for maintaining an account is concluded for an indefinite period. The Buyer may close the account at any time, without giving a reason and without incurring any costs. If account deletion is not available directly from the user panel, the Buyer may contact the Seller by e-mail.
  6. The Order form service is provided for the duration of the Buyer’s use of the form and ends when the Order is successfully placed or when the Buyer abandons the ordering process.
  7. The Buyer is required to provide information that is accurate and consistent with the actual state of affairs.
  8. It is prohibited to provide content through the Store that is contrary to applicable law.
  9. A Buyer who has an account should protect the credentials enabling access to it against unauthorised access by third parties.
  10. Use of services provided electronically involves risks typical of Internet use, including in particular malicious software, attempts to obtain data fraudulently and attempts by unauthorised persons to gain access to an account. Users are advised to use up-to-date software and appropriate device security and to keep their login credentials confidential.
  11. If the Store provides access to product reviews, the Seller shall provide information on whether and how it ensures that published reviews originate from persons who have used or purchased the relevant product.
  12. Complaints concerning services provided electronically may be submitted to kontakt@szlachetnafotografia.com.
  13. A complaint should, where possible, include information enabling identification of the user and a description of the problem. Failure to provide such information does not deprive the Buyer of the right to submit a complaint if it can be considered on the basis of the information provided.
  14. The Seller shall respond to a Consumer’s complaint concerning services provided electronically within 14 days of receipt. The response shall be provided on paper or another Durable Medium.

§4. Placing Orders and Conclusion of the Contract

  1. Orders may be placed in the Store 24 hours a day, 7 days a week.
  2. To place an Order, the Buyer in particular:
    • selects Goods, Digital Content or a Workshop,
    • adds the selected items to the shopping cart,
    • provides the information necessary to process the Order,
    • selects an available delivery and payment method,
    • reviews the information required before conclusion of the contract,
    • accepts these Terms and Conditions,
    • places the Order using the “Order and Pay” button.
  3. The contract between the Buyer and the Seller is concluded when the Order is successfully placed using the “Order and Pay” button.
  4. After conclusion of the contract, the Seller sends confirmation of the contract to the e-mail address provided by the Buyer on a Durable Medium, including the information required by law, unless such information has already been provided to the Buyer on a Durable Medium.
  5. In the case of Digital Content, the confirmation shall also include any confirmation required by law concerning the Buyer’s consent to commencement of supply of Digital Content before expiry of the withdrawal period, if such consent has been given.
  6. If, after conclusion of the contract, an exceptional stock-level error or another circumstance affecting performance of the Order becomes apparent, the Seller shall contact the Buyer without undue delay in order to agree on the method of performance of the contract.
  7. Any change to the ordered Goods, delivery method, processing time or any other alternative solution requires the Buyer’s consent.
  8. Sections 6–7 do not grant the Seller the right to unilaterally terminate a validly concluded contract because of a stock-level error.
  9. If performance of the contract becomes impossible for objective reasons, in particular because of a legal prohibition applicable to the sale or transport of particular Goods to a specific recipient or destination, the relevant provisions of law shall apply. The Seller shall inform the Buyer without undue delay and refund payments received where, under applicable law, performance cannot be completed.
  10. Certain Goods may be subject to restrictions concerning the category of recipient, method of transport or country of destination resulting from applicable law, safety requirements or the rules of transport providers. Information concerning such restrictions shall be provided before the Order is placed.

§5. Prices and Payments

  1. Prices of Goods, Digital Content and Workshops displayed in the Store include applicable taxes and are expressed in euros (EUR) unless expressly stated otherwise.
  2. The price of Goods does not include delivery costs unless the information displayed in the Store expressly states otherwise.
  3. The total price of the Order, including delivery costs and any other costs the Buyer is required to pay, is displayed before the Order is placed.
  4. Where the Seller announces a reduction in the price of Goods, the Seller shall also provide information about the lowest price of those Goods applied during the 30 days preceding the price reduction, in cases required by applicable law.
  5. Available payment methods are indicated during the ordering process. The Store offers in particular:
    • bank transfer,
    • PayPal.
  6. Orders intended for personal collection must also be paid for in advance.
  7. The Seller issues sales documents in accordance with applicable law.

§6. Order Processing and Delivery

  1. The standard Order processing time is up to 3 Business Days, unless a different period is indicated in the description of a particular product.
  2. The processing period is calculated:
    • for bank transfers – from the date the payment is credited to the Seller’s bank account;
    • for electronic payments – from the date the Seller receives confirmation that the payment has been successfully made.
  3. If an Order contains products with different processing times, the Order is generally processed according to the longest stated processing time.
  4. Goods may be delivered within Poland, to other European Union Member States and to countries outside the European Union, subject to restrictions applicable to particular Goods or transport providers.
  5. Available delivery methods and their costs are displayed to the Buyer before the Order is placed.
  6. For deliveries outside the European Union, customs duties, import taxes or other public charges may be imposed in the destination country. Their amount and the obligation to pay them are determined by the laws of the country to which the Order is delivered.
  7. The Buyer may select personal collection in Trąbki Wielkie, Poland.
  8. Personal collection requires prior arrangement of a collection time with the Seller by e-mail. The Seller’s address is not a permanently open retail outlet.
  9. If Goods are sent to a Consumer using a carrier selected from among the delivery methods offered by the Seller, the risk of accidental loss of or damage to the Goods passes to the Consumer when the Goods are delivered to the Consumer or to a third party indicated by the Consumer, other than the carrier.
  10. If the Consumer independently selects a carrier not offered by the Seller, the transfer of risk shall be governed by applicable law.

§7. Right of Withdrawal

  1. A Consumer and, to the extent provided for by applicable law, an Entrepreneur with consumer rights may withdraw from a distance contract within 14 days without giving any reason.
  2. In the case of a contract for the sale of Goods, the withdrawal period begins on the day on which the Consumer or a third party indicated by the Consumer, other than the carrier, takes physical possession of the Goods.
  3. If an Order includes several Goods delivered separately, in batches or in parts, the withdrawal period begins on the day on which the last item, batch or part is received.
  4. In relation to other contracts, the withdrawal period begins on the date on which the contract is concluded, subject to exceptions provided for by applicable law.
  5. A declaration of withdrawal may be made in any unequivocal form, including in particular:
  6. The Consumer may use the model withdrawal form included at the end of these Terms and Conditions but is not required to do so.
  7. To meet the withdrawal deadline, it is sufficient to send the declaration before the relevant period expires.
  8. Following withdrawal, the Consumer shall return the Goods without undue delay and no later than 14 days after informing the Seller of the withdrawal. The deadline is met if the Goods are sent back before the 14-day period expires.
  9. Goods may be returned to:

Szlachetna Fotografia
Radosław Brzozowski
ul. Akacjowa 1
83-034 Trąbki Wielkie
Poland

  1. The above address is not a permanently staffed in-person returns desk. If the Consumer wishes to return Goods in person, the date and time must be agreed with the Seller in advance.
  2. The Consumer bears the direct cost of returning the Goods unless the Seller has agreed to bear that cost or applicable law requires the Seller to bear it.
  3. The Seller shall refund all payments received from the Consumer that are subject to reimbursement, including the cost of the least expensive standard delivery method offered by the Seller.
  4. If the Consumer selected a delivery method that was more expensive than the least expensive standard delivery method offered by the Seller, the Seller is not required to refund the additional costs resulting from that choice.
  5. The refund shall be made without undue delay and no later than 14 days after the Seller receives the declaration of withdrawal.
  6. The Seller shall make the refund using the same payment method used by the Consumer unless the Consumer expressly agrees to another method that does not involve any costs for the Consumer.
  7. The Seller may withhold the refund until the Goods have been returned or until the Consumer provides evidence that the Goods have been sent back, whichever occurs first, unless the Seller has offered to collect the Goods.
  8. The Consumer is liable for any reduction in the value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning, provided that the Consumer was properly informed of the right of withdrawal.
  9. Merely opening the packaging does not automatically result in loss of the right of withdrawal unless the statutory conditions for exclusion of that right are met in the particular case.
  10. This section applies accordingly to an Entrepreneur with consumer rights to the extent that applicable law grants that person a right of withdrawal.

§8. Products Made to Individual Specifications

  1. Standard Goods offered in the Store may be freshly prepared or produced after the Order has been received.
  2. The mere fact that a standard product is prepared after an Order is placed does not mean that it has been made according to the Buyer’s individual specifications and does not result in loss of the right of withdrawal.
  3. The right of withdrawal does not apply in cases provided for by law, including in particular Goods that are not prefabricated and are produced according to the Consumer’s specifications or are intended to satisfy the Consumer’s individual needs.
  4. This applies in particular to products prepared following individual arrangements with the Seller, for example products with a non-standard composition, concentration, quantity, volume, format or other individually specified parameters.
  5. Information that the product is individually made and that the statutory right of withdrawal therefore does not apply shall be provided to the Consumer before conclusion of the contract.

§9. Digital Content

  1. The Store may offer Digital Content, including in particular books in PDF format.
  2. Before purchasing Digital Content, the Buyer shall receive information about its type, format, functionality and relevant technical requirements, compatibility and interoperability where these are relevant to use of the Digital Content.
  3. Digital Content is supplied in the manner described in the product listing, generally through a link enabling the file to be downloaded.
  4. Unless otherwise stated in the product description:
    • the download link remains active for 7 days,
    • the file may be downloaded a maximum of 2 times,
    • the Digital Content is made available once payment has been recorded by the Store’s system.
  5. The limitation on the number of downloads and the period for which the link remains active concerns the ability to download the file from the Store’s server. It does not cause a lawfully downloaded file to expire after that period.
  6. Purchase of Digital Content does not transfer economic copyright to the Buyer unless expressly stated otherwise.
  7. The Buyer may use the Digital Content for personal use within the limits permitted by applicable law and the terms indicated for the relevant product.
  8. In the case of paid Digital Content supplied without a tangible medium, the Consumer loses the statutory right of withdrawal only where:
    • the Seller has begun performance with the Consumer’s prior and express consent before expiry of the withdrawal period;
    • before performance begins, the Consumer has been informed that once the Seller has fully performed the contract, the Consumer will lose the right of withdrawal, and the Consumer has acknowledged this;
    • the Seller has provided the Consumer with the confirmation required by law on a Durable Medium.
  9. If the conditions specified in section 8 are not met, merely making the file available does not deprive the Consumer of the right of withdrawal.
  10. If Digital Content is not supplied or is not in conformity with the contract, the Consumer has the rights specified in §12 and under the Polish Consumer Rights Act.

§10. Workshops

  1. The Store may offer the possibility of purchasing a place on a Workshop taking place on the date specified in the offer description.
  2. The contract is concluded in accordance with §4. A place on the Workshop is reserved once payment has been made.
  3. The scope, date, location, price and other relevant information concerning the Workshop are specified in its description.
  4. Irrespective of the scope of any statutory right of withdrawal applicable to the Workshop, the Seller grants the Buyer an additional contractual right:

The Buyer may cancel participation in a Workshop before it begins and receive a full refund of the price paid.

  1. Cancellation may be sent to kontakt@szlachetnafotografia.com.
  2. If a Workshop is cancelled by the Seller, including due to circumstances beyond the Seller’s control, the Buyer may choose:
    • participation on another agreed date, or
    • a full refund of the price paid.
  3. A change of the Workshop date requires the Buyer’s consent.
  4. This section does not limit any rights available to the Buyer under mandatory provisions of applicable law.
  5. Online mentoring and individual workshops arranged directly with the Seller by e-mail are not standard services ordered through the Store’s shopping cart. The terms of such services are agreed individually before conclusion of the relevant contract, without prejudice to any rights granted to the Buyer by mandatory provisions of law.

§11. Complaints Concerning Goods – Consumers

  1. The Seller is liable to the Consumer for conformity of the Goods with the contract under the Polish Consumer Rights Act of 30 May 2014.
  2. The Seller is liable for any lack of conformity of the Goods with the contract existing at the time of delivery and revealed within 2 years from that time, unless the shelf life of the Goods is longer.
  3. A lack of conformity revealed within 2 years from delivery is presumed to have existed at the time of delivery unless proven otherwise or unless such a presumption is incompatible with the nature of the Goods or the nature of the lack of conformity.
  4. If the Goods are not in conformity with the contract, the Consumer may request:
    • repair, or
    • replacement.
  5. The Seller may replace the Goods where the Consumer requests repair, or repair the Goods where the Consumer requests replacement, if the remedy chosen by the Consumer is impossible or would involve excessive costs for the Seller.
  6. In assessing whether costs are excessive, all circumstances of the case shall be taken into account, including in particular the significance of the lack of conformity, the value of Goods that are in conformity with the contract, and any excessive inconvenience to the Consumer resulting from use of the alternative remedy.
  7. If both repair and replacement are impossible or would involve excessive costs for the Seller, the Seller may refuse to bring the Goods into conformity with the contract.
  8. Repair or replacement shall be carried out within a reasonable time after the Seller has been informed of the lack of conformity and without significant inconvenience to the Consumer, taking into account the nature of the Goods and the purpose for which the Consumer acquired them.
  9. The costs of repair or replacement, including in particular postage, transport, labour and material costs, shall be borne by the Seller.
  10. The Consumer shall make the Goods subject to repair or replacement available to the Seller. The Seller shall collect such Goods from the Consumer at the Seller’s expense.
  11. In the circumstances provided for by law, the Consumer may make a declaration requesting:
  • a price reduction, or
  • withdrawal from the contract.
  1. This applies in particular where:
  • the Seller has refused to bring the Goods into conformity with the contract;
  • the Seller has failed to bring the Goods into conformity with the contract;
  • the lack of conformity continues despite an attempt to repair or replace the Goods;
  • the lack of conformity is sufficiently significant to justify an immediate price reduction or withdrawal from the contract without first requesting repair or replacement;
  • it is clear from a statement by the Seller or from the circumstances that the Seller will not bring the Goods into conformity within a reasonable time or without significant inconvenience to the Consumer.
  1. The reduced price shall be in the same proportion to the contract price as the value of the non-conforming Goods bears to the value of Goods that would be in conformity with the contract.
  2. The Seller shall refund amounts due as a result of the Consumer exercising the right to a price reduction without undue delay and no later than 14 days after receiving the Consumer’s declaration of price reduction.
  3. The Consumer may not withdraw from the contract if the lack of conformity is minor. A lack of conformity is presumed to be significant.
  4. Where the lack of conformity concerns only some of the Goods supplied under the contract, the Consumer may withdraw from the contract in relation to those Goods and, in cases provided for by law, also in relation to other Goods acquired together with them.
  5. In the event of withdrawal from the contract due to lack of conformity, the Consumer shall return the Goods to the Seller at the Seller’s expense.
  6. The Seller shall refund the price without undue delay and no later than 14 days after receiving the Goods or evidence that they have been sent back.
  7. The price shall be refunded using the same payment method used by the Consumer unless the Consumer expressly agrees to another method that does not involve any costs for the Consumer.
  8. A complaint may be submitted in any legally permissible form. To facilitate consideration of the complaint, it may be sent:
  1. A complaint should preferably include:
  • information enabling identification of the Buyer and the Order,
  • a description of the problem,
  • the Consumer’s request.
  1. Failure to use the suggested form or to provide some of the above information does not deprive the Consumer of the right to submit a complaint if it can be considered on the basis of the information provided.
  2. A fiscal receipt or other specific proof-of-purchase document is not required in order to submit or consider a complaint.
  3. Where it is necessary for the Goods to be provided to the Seller for the purposes of the complaint, the Consumer shall make the Goods available and the Seller shall arrange collection at the Seller’s expense in cases provided for by applicable law.
  4. If the parties agree that the Goods are to be sent to the Seller, they may be sent to:

Szlachetna Fotografia
Radosław Brzozowski
ul. Akacjowa 1
83-034 Trąbki Wielkie
Poland

  1. The above address is not a permanently staffed in-person complaints desk. Any in-person delivery of Goods requires prior arrangement with the Seller.
  2. The Seller shall respond to a Consumer’s complaint within 14 days of receipt.
  3. If the Seller does not respond within 14 days, the complaint shall be deemed accepted.
  4. The response shall be provided to the Consumer on paper or another Durable Medium.
  5. This section applies accordingly to an Entrepreneur with consumer rights to the extent provided for by applicable law.

§12. Complaints Concerning Digital Content – Consumers

  1. The Seller is liable to the Consumer for conformity of Digital Content with the contract in accordance with the Polish Consumer Rights Act.
  2. The Seller shall supply Digital Content without undue delay after conclusion of the contract unless the parties have agreed otherwise.
  3. If the Seller fails to supply Digital Content, the Consumer may request that it be supplied. If the Digital Content is not supplied without undue delay or within an additional period expressly agreed by the parties, the Consumer may withdraw from the contract.
  4. In circumstances specified by applicable law, the Consumer may withdraw from the contract because Digital Content has not been supplied without first requesting supply.
  5. In the case of Digital Content supplied on a one-off basis or in separate parts, the Seller is liable for a lack of conformity existing at the time of supply and revealed within 2 years from that time.
  6. A lack of conformity of Digital Content revealed within one year from the time of supply is presumed to have existed at the time of supply, subject to exceptions provided for by applicable law.
  7. If Digital Content is not in conformity with the contract, the Consumer may request that it be brought into conformity.
  8. The Seller may refuse to bring Digital Content into conformity where doing so is impossible or would involve excessive costs.
  9. Digital Content shall be brought into conformity within a reasonable time after the Seller has been informed of the lack of conformity, without significant inconvenience to the Consumer and at the Seller’s expense.
  10. In the circumstances provided for by law, the Consumer may request a price reduction or withdraw from the contract, in particular where:
  • bringing the Digital Content into conformity is impossible or would involve excessive costs;
  • the Seller has failed to bring it into conformity within a reasonable time;
  • the lack of conformity continues despite an attempt to remedy it;
  • the lack of conformity is sufficiently significant to justify an immediate price reduction or withdrawal;
  • it is clear from a statement by the Seller or from the circumstances that the Seller will not bring the Digital Content into conformity within a reasonable time or without significant inconvenience to the Consumer.
  1. Where Digital Content is supplied in return for payment of a price, the Consumer may not withdraw from the contract on the grounds of lack of conformity if the lack of conformity is minor. A lack of conformity is presumed to be significant.
  2. Any refund due as a result of withdrawal from the contract or a price reduction shall be made without undue delay and no later than 14 days after the Seller receives the relevant declaration from the Consumer.
  3. A complaint concerning Digital Content may be submitted to kontakt@szlachetnafotografia.com.
  4. The Seller shall respond to a Consumer’s complaint within 14 days of receipt. Failure to respond within that period shall result in the complaint being deemed accepted.
  5. This section applies accordingly to an Entrepreneur with consumer rights to the extent provided for by applicable law.

§13. Alternative Dispute Resolution

  1. A Consumer may use out-of-court methods of resolving consumer disputes and pursuing claims.
  2. Information concerning entities authorised to conduct alternative dispute resolution proceedings and the rules governing access to such procedures is available in particular on the website of the Polish Office of Competition and Consumer Protection (UOKiK) and in the register of authorised entities maintained by the President of UOKiK.
  3. In matters concerning the sale of Goods or provision of services, a Consumer may in particular contact the competent Provincial Inspectorate of Trade Inspection, which conducts alternative consumer dispute resolution proceedings and operates permanent consumer arbitration courts.
  4. If a dispute is not resolved following a complaint submitted by the Consumer, the Seller shall provide the Consumer on paper or another Durable Medium with the statement required by applicable law concerning whether the Seller intends to apply for alternative dispute resolution, agrees to participate in such proceedings or refuses to participate.
  5. Use of an alternative dispute resolution procedure does not deprive the Consumer of the right to bring a claim before a competent court.

§14. Final Provisions

  1. Matters not regulated by these Terms and Conditions shall be governed by applicable law, including in particular the Polish Civil Code, the Polish Consumer Rights Act and the Polish Act on Providing Services by Electronic Means.
  2. Nothing in these Terms and Conditions excludes or limits any rights of a Consumer or an Entrepreneur with consumer rights arising from mandatory provisions of applicable law.
  3. These Terms and Conditions apply to contracts concluded from the date on which they enter into force.
